Privacy Policy
This Privacy Policy sets out how Wagner Pharmaceuticals Pty Limited ABN 48 670 339 867 (Wagner Pharmaceuticals, we, us, our) collects, holds, uses and discloses your Personal Information. It also explains how you can request access to, or correction of, the Personal Information we hold about you, or make a complaint about how we handle your Personal Information.
Definitions
Personal Information generally means information or an opinion about an identified individual, or an individual who is reasonably identifiable. Personal Information includes Sensitive Information and Health Information.
Health Information includes information or an opinion about the health of an individual or a health service provided to an individual.
Sensitive Information includes information or an opinion about an individual’s racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual orientation or practices, criminal record, as well as Health Information, genetic information and biometric information.
Terms are more fully defined in the Privacy Act 1988 (Cth) (Privacy Act).
What types of Personal Information does the Wagner Pharmaceuticals collect, how is it collected and for what purpose is it used?
Pharmacy owners and employees
Wagner Pharmaceuticals collects your Personal Information where you are an individual that owns a pharmacy or an employee of a pharmacy business. The Personal Information we collect includes your name and details of your business (including your purchasing and (deidentified with respect to patient data) dispensing patterns of the therapeutic goods we distribute).
This Personal Information is generally collected from our wholesaler for the purpose of improving our business.
We may also collect your Personal Information under processes with our wholesaler to replace expired stock for a pharmacy business.
Health professionals
Where you are a health professional (such as a doctor or pharmacist) we collect your name and contact details when you provide us with queries, reports or feedback in relation to products or pharmacovigilance information (i.e., the monitoring of medicines and other therapeutic goods). Your contact information is used for follow-up activities, including those that are part of standard pharmacovigilance activities. If we’re unable to collect your contact details, we may be unable to properly investigate and follow-up on your query, feedback or report.
If you are a health professional and provide Wagner Pharmaceuticals with Health Information of your patients, Wagner Pharmaceuticals expects that you obtain the consent of your patient before disclosing their Health Information to us. The details of your patient may be deidentified where we are not satisfied that you have obtained that consent.
Patients
If you are a patient, your Health Information is collected when a product quality complaint or serious adverse reaction report is made to Wagner Pharmaceuticals directly by you or through your health professional. This Personal Information is generally collected on behalf of Wagner Pharmaceuticals through its service provider. The specific types of Health Information we may collect include your name, contact details, medical status and background, any medications taken, any treatment received and the contact details of your treating health professional.
Health Information of patients is collected for the purpose of investigating and following up product complaints and for pharmacovigilance purposes. Pharmacovigilance means activities related to detecting, assessing, understanding and preventing adverse effects and other medicine-related problems. You have the option to not provide information that identifies you such as your full name and date of birth when making a product quality complaint or serious adverse reaction report. However, if you choose not to provide identifying information, we will not be able to fully investigate your product quality complaint or report of serious adverse reaction, including being able to contact your healthcare professional, with your consent, to provide additional medical information.
We may also request information about Aboriginal or Torres Strait Islander status for the purpose of reports made to government health departments. You do not have to provide this information to us.
Service providers
Wagner Pharmaceuticals collects your Personal Information if you own, or work for, a business that provides services to Wagner Pharmaceuticals (service provider). This information generally consists of your name and business contact information and is generally collected directly from you or from your employer. Your Personal information is used for the purposes of facilitating the business relationship (including as contemplated under any contract). If we are not able to collect this information, we will not be able to communicate with you.
Potential Employees
Wagner Pharmaceuticals also collects Personal Information from individuals who apply for a position with Wagner Pharmaceuticals. Where you have applied for a position as employee, your name, contact details, curriculum vitae, professional experience, educational qualifications, and other associated information are collected either through a service provider or directly from you. This Personal Information is used for assessing your application for employment. In some cases, this information is retained for consideration for any future employment positions.
Additional reasons why we hold, use and disclose your Personal Information
In addition to the specific reasons we provide for collecting your Personal Information above, we also hold and use your Personal Information for the following purposes:
- To resolve a complaint you’ve made to us.
- To verify your identity, for example when you’ve requested access to or correction of your Personal Information.
- To comply with our legislative and regulatory requirements.
Disclosure of your Personal Information
Where you are a health professional or patient (to the extent your Personal Information has not been deidentified) and your details have been collected for pharmacovigilance or product complaint purposes, your Personal Information is disclosed to service providers as well as to our suppliers to facilitate compliance and follow up pharmacovigilance activities required under regulatory requirements and to investigate product complaints. We may also disclose your Personal Information to:
- Any person authorised by you.
- Regulatory authorities, law enforcement and other government bodies where we are required or authorised by law to do so.
- Our professional advisers for the purpose of obtaining their professional services (in the case of our legal advisers, these services will include assessing our legal obligations and defending any legal claims or potential claims).
- Investors and prospective purchasers who purchase or invest in, or may purchase or invest in, a part or all of our business or assets (including their advisers and representatives).

When you visit our website, we may collect information about your computer or electronic device (e.g., your Internet Protocol (IP) address, browser type, and date and time of your request) by using automatic systems of browsing data collection, such as cookies. A cookie is a file stored on your hard drive; it does not contain intelligible information, but it allows linking between a terminal and information about your preferences. These tracking technologies are used to provide additional functionality to your use of our resources; for example, to identify you as a healthcare professional, or to remember your preferences and selections. You may limit or remove cookies from your computer or device, but, in these situations, our ability to provide optimal service may be limited.
Storage and Security of Personal Information
Wagner Pharmaceuticals will take reasonable steps to secure all Personal Information from misuse, interference, loss and unauthorised access.
Personal Information is stored on secure servers that are protected in controlled facilities, or in hardcopy paper records stored in secure access facilities. Wagner Pharmaceuticals requires its employees and service providers to protect the confidentiality of any Personal Information held by us.
Accessing and correcting your Personal Information
You may request access to the Personal Information (including your Sensitive Information) that we hold about you. You can also ask for corrections to be made to it. To do so, please contact us using the contact details provided below.
We will seek to verify your identity before we allow access, or make changes, to your Personal Information.
There is no fee for requesting corrections to your Personal Information or for us to make those corrections. In some circumstances, we may charge you a reasonable amount for providing you access to your Personal Information to cover the costs of locating the information, copying it and supplying it to you.
We are not required to provide you with access to your Personal Information in certain limited circumstances, for example where a Court or Tribunal order requires us to deny access. There are also certain circumstances in which we are not required to correct your Personal Information – for example, where we are not satisfied that the information we have on record for you is inaccurate, out-of-date, incomplete, irrelevant or misleading.
However, if we refuse to give you access to or to correct your Personal Information, we will give you a notice explaining our reasons (except to the extent it would be unreasonable or unlawful for us to do so) and provide you with information on how you can complain about our refusal.
